Apex Auto Leads LLC maintains this site (the “Site”) for your personal entertainment, information, education, and communication. ALL SERVICES ARE GOVERNED BY THE GENERAL TERMS AND CONDITIONS THAT ARE LISTED BELOW.

1. INTRODUCTION

In this Service Agreement (“Agreement”), “you” and “your” refer to each customer (“Customer”) and its agents, including each person listed in your account information as being associated with your account, and “we”, “us”, and “our” refer collectively to Apex Auto Leads LLC. This Agreement explains our obligations to you and your obligations to us in relation to the Apex Auto Leads LLC service(s) you purchase.

2. Description of Service

Apex Auto Leads LLC may make available for purchase, from time to time, a variety of Lead Subscription services. Subject to the terms and conditions of this Agreement and during the term of this Agreement, Apex Auto Leads LLC agrees to provide to you the Lead Subscription Services you purchase. Apex Auto Leads LLC reserves the right to amend its Lead Subscription Services offerings and to add, delete, suspend, or modify the terms and conditions of such Lead Subscription Services, at any time and from time to time, and to determine whether and when any such changes apply to both existing and future customers.

3. Fees and Payment Terms

Payment for the Lead Subscription Services selected by you will be on a pre-paid basis, due and payable at the beginning of the term, and will continue billing at the beginning of any and all subsequent terms until such time as you or we terminate the Lead Subscription Services.

4. Suspension and/or Termination

If you breach any term of this Agreement, including, but not limited to, the terms of this Schedule or the Acceptable Use Policy, Apex Auto Leads LLC may, in its sole and exclusive discretion, suspend or terminate your Lead Subscription Services immediately and without notice to you. Lead Subscription Services Fees may continue to accrue on suspended accounts, and you will continue to remain responsible for the payment of any Services fees that accrue during the period of suspension. Redistribution of leads by you will result in termination of this agreement without refund. This also applies to all companies and brokers who operate more than one company or under different names.

5. Refund and Cancellation Policy

Apex Auto Leads LLC does not in any way provide refunds on the subscription of Credits (Leads). However, a cancellation can be made (15) business days before the next billing cycle to pause all future payments and Credits. Companies that do cancel will forfeit their spot in rotation and will be placed back into rotation upon availability.

The remainder of credits is available for (30) days after the first written cancellation. If there is no availability exceeding (30) days, a discount may apply to future subscriptions.
